Abstract:
The stability of farmland circulation contracts helps the development of agricultural land transfer markets, promotes the agricultural land scale management, and improves the effective utilization of agricultural land resources. Under the background of promotion of rural land right policy and the gradual development of agricultural land market in China, based on a survey data of 12 counties in Jiangxi Province, and applying the multivariate ordinal logit regression model, this paper empirically analyzed the relationship between farmland ownership and the stability of agricultural land transfer contracts. Results show that 83.14% of those transfer-out households have completed the land use right certification process, and only 32.40% of the households chose the written contract during the transfer process. The overall standardization of the transfer contract was poor and the legal binding force was low. The determination of the right of farmland does not directly affect the stability of the transfer contract so that the policy effect fails to stand out. However, the non-convergence of the transfer, the standardization of contracts, and the recent land adjustments will reduce the stability of farmland transfer contracts. Therefore, it is an important option to improve the stability of agricultural land transfer contracts by properly applying the results of farmland right verification, fully integrating relational contracts and formal contracts, and maintaining the stability of contracting relations.
